Conclusion

After debating it, it has been deemed that it WAS RDM and that rabbit should not be allowed to kill you without instigation after the jail. Although since there is no proof of exploiting, I can only give him a warn for RDM. The previous RP interaction has ended since he was jailed and he would only be allowed to kill you if he broke out of the cuffs first, or you instigated a fight first (after he broke out) in the PD jail which has been proven as you didn't instigate first and so it is RDM.
